An expert witness has one duty above all others — to the court, not to whoever is instructing them. That means giving a genuinely independent opinion, disclosing the facts and assumptions it relies on, and being upfront about the limits of what falls inside our expertise.

A vehicle is generally treated as a total loss when repair cost, plus residual value, exceeds what it was worth immediately before the damage. In practice, disputes rarely come from the repair estimate — they come from the pre-accident value the insurer has used as the baseline.

Pre-accident value is usually set from a market survey of comparable vehicles. The problem is that “comparable” is doing a lot of work in that sentence. A vehicle with full service history and genuine low kilometres is not the same as the cheapest listing that happens to match on make and model.

An independent total loss assessment re-examines both sides: whether the repair estimate reflects the actual damage, and whether the pre-accident valuation reflects the specific vehicle rather than a generic version of it.

If you're looking at a total loss figure that doesn't match expectations, the first question isn't “is the repair estimate right” — it's “what vehicles was this valuation actually built from.”

The Expert Witness Code of Conduct sets out core obligations that are straightforward to state: the expert's paramount duty is to the court, the opinion given must be genuinely independent, and the report must disclose the facts and assumptions the opinion is based on — not just the conclusion.

Reports fall over under cross-examination in predictable places: an opinion stated without disclosing the underlying facts, an assessor commenting outside their actual expertise, or a report written in the language of advocacy rather than analysis.

The practical takeaway for a solicitor briefing an assessor is to ask for the Code of Conduct acknowledgment and methodology disclosure as standard, even for a report only intended for a claims file at this stage — matters escalate, and a report built to the litigation standard from the outset doesn't need to be retrofitted later under time pressure.

Always confirm turnaround at the time of instruction, particularly around court dates or mediation deadlines, and confirm at the outset whether your expert is available and willing to attend for cross-examination if the matter proceeds to hearing.

Caravans and motorhomes fail in ways cars don't. Water ingress is the biggest one — a small impact or a failed seal around a window or roof vent can let moisture into wall cavities, delaminating panelling and rotting timber framing long before it's visible from outside.

Chassis and structural assessment is the second major difference. Caravans flex under towing loads in ways a car's body doesn't, and a chassis stressed in a rollover or heavy impact can fail well below what a visual inspection would suggest.

This is why a motor-vehicle-style repair estimate applied to a caravan claim tends to understate both the damage and the cost. A proper caravan assessment inspects wall cavities and seals for moisture ingress, checks chassis alignment, and accounts for the specialist trades any genuine repair will require.

Before accepting a settlement figure, it's worth confirming the assessment actually checked for these caravan-specific failure modes, rather than applying a car-repair estimate to a very different structure.

Watercraft damage claims typically involve at least two largely independent systems: the hull, and the engine and drivetrain. A collision or grounding can damage the hull without touching the engine, or damage the trailer in transit without the vessel itself being affected.

Hull assessment depends heavily on construction — fibreglass, aluminium and timber hulls fail differently, and impact damage can be more extensive below the waterline than what's visible above it.

Engine assessment after a water-related incident needs to account for damage that may not present immediately — corrosion and electrical faults from saltwater exposure can take days or weeks to fully manifest.

For a total loss determination, the same principle applies as with vehicles: the pre-incident valuation needs to reflect the specific vessel — engine hours, hull condition and documented maintenance — not a generic figure for the make and length.

A repair cost dispute usually comes down to scope, not price. The quoted rate for a panel or a part is rarely the issue — what's missing from the quote is. Hidden damage found only once a vehicle is stripped down is the most common gap between an initial estimate and the real cost of repair.

An independent review re-inspects the vehicle against the original damage report, checking whether the scope of work actually accounts for everything that was damaged — not just what was visible in the first assessment.

Where a scope genuinely was correct at the time but circumstances changed — further damage found mid-repair, for example — a supplementary assessment is the right next step, not a dispute over the original figure.

If you're disputing a repair cost assessment, ask for the itemised scope first. Most disputes resolve once it's clear whether the disagreement is about price or about what was actually included.

Diminished value is the difference between what a vehicle is worth after being repaired, and what an equivalent vehicle with no accident history would be worth. Even a structurally sound repair carried out to specification tends to leave a vehicle worth less on resale.

This is a different question to “was the repair done properly.” A repair can be done properly and diminished value can still exist — buyer willingness to pay is affected simply by a disclosed accident history.

A diminished value assessment compares the specific repaired vehicle against genuinely comparable unaccrued vehicles in the current market, supported by an inspection of the repair itself — panel alignment, paint matching, and whether the damage zone involved anything load-bearing.

Insurers don't always accept diminished value as a matter of course, and the burden sits with the claimant to demonstrate both the value gap and that it's attributable to the incident. That's exactly what the assessment report needs to show.
